*Plan review fees must be paid upon submission of Erosion Control Plan and are non-refundable. In the event a Plan is disapproved, a re-review fee equal to 50% of the initial submission fee will be charged.

The Durham County Stormwater & Erosion Control Office issues permits for all land-disturbing activities within the City of Durham and Durham County. Office hours are Monday – Friday, 8:30 AM to 5:00 PM.



LAND-DISTURBING PERMIT REQUIREMENTS

A. SITES LESS THAN 12,000 SQ./FT.

No plan or permit required.
Appropriate measures to control sediment must still be implemented.

B. SITES GREATER THAN 12,000 SQ./FT. TO 20,000 Sq. Ft.

1. No plan required
2. Permit fee of $250.00
3. Notarized Financial Responsibility Form
4. Zoning Compliance Form from Planning Department
5. Tree Protection Fencing Certification and Inspection (If applicable)

C. SITES GREATER THAN 20,000

1. Three (3) sealed copies of Erosion Control Plan
2. Notarized Financial Responsibility Form
3. Plan Review And Permit Fee (see fee schedule above)
4. Zoning Compliance Form from Planning Department
5. Tree Protection Fencing Certification and Inspection (If applicable)

D. SITES GREATER THAN 5 ACRES

1. All items from Section C plus a performance security (Amount of security to be determined during plan review. Security amount will be equal to $4,000/disturbed acre)

E. CUMULATIVE ACCOUNTING FOR SUBDIVISIONS

When multiple parties are conducting land-disturbing activities pursuant to a site plan, all of these land disturbing activities are aggregated and covered by both the UDO and the NPDES program. Both of these require aggregation of properties under diverse ownership which are developed as a unit, or pursuant to a “larger common plan of development.”

Within such a site, when an individual is conducting land-disturbing activity on two or more lots concurrently, the site acreage is the cumulative land-disturbing activity area for these properties within the subdivision. If the cumulative land-disturbing activities are greater than 20,000 sq. ft., than an erosion control plan is required. Durham County has a generic single family lot erosion control plan which may be used, “Single Family Erosion Control Options, May 3, 2006.” If the entity wishes to use alternative erosion control methods, the erosion plans must be pre-approved by Durham County Stormwater and Erosion Control. Also, NPDES General Permit NCG010000 applies to entities with cumulative land-disturbing activities greater than one (1) acre.
